Financia Europa account in Spain: who can offer it

The Cuenta de Ahorro e Inversión Financia Europa is Spain’s answer to the EU push for tax-advantaged retail investment accounts, and it is now law through Real Decreto-ley 29/2026, after the first decree that created it was struck down within two days. The account sits in a new Title XI of Ley 6/2023 on securities markets and investment services, with its tax regime in a new Article 95 ter of the Personal Income Tax Law. Only credit institutions and investment firms can run it. A payment account must be attached to every one of them, and that account can be held with any authorised payment service provider. This piece covers who may offer it, how the money moves, the caps and the tax treatment, and why nobody can sell it yet.

1. Which text is in force

The account first appeared in Real Decreto-ley 26/2026 of 29 September (BOE-A-2026-20266), a housing decree published on 30 September 2026. On 2 October 2026 the Congress of Deputies voted on it under Article 86.2 of the Constitution and decided to repeal it. The resolution ordering publication of that decision (BOE-A-2026-20526) lists the new Title XI of Ley 6/2023 and the new Personal Income Tax provisions among the amendments that lost effect.

The Government then approved Real Decreto-ley 29/2026 of 6 October (BOE-A-2026-20823), published on 7 October and in force from 8 October 2026. Its Article 21 inserts the same Title XI into Ley 6/2023. Comparing the two BOE texts line by line shows the Financia Europa provisions carried over word for word, with the same article numbers.

Real Decreto-ley 29/2026 still needs to be validated by Congress. With the chamber dissolved, that falls to its Permanent Deputation. When this was written, the BOE consolidated text showed no later amendment and no resolution validating or repealing the decree had been published. Check the BOE before you rely on the account.

2. What the account is

Article 341 defines the account as a contract for investment and ancillary services between one holder and one provider. It is made up of a securities account and a linked cash account, and it cannot be assigned or transferred. The holder must be an individual who pays Spanish personal income tax (Article 342.1.b). Each taxpayer may hold only one account at a time, and the name “Cuenta de Ahorro e Inversión Financia Europa” is reserved for contracts that meet Title XI and the tax rules.

The policy background is EU-level. The preamble cites the “Finance Europe” label agreed by seven Member States in June 2025, and Commission Recommendation (EU) 2025/2029 of 30 September 2025 on increasing the availability of savings and investment accounts with simplified and advantageous tax treatment (OJ L, 8.10.2025).

3. Who may offer it: Article 343

Article 343 names three groups of provider:

  • Spanish credit institutions authorised under Ley 10/2014 that may provide investment services under Article 128.3 of Ley 6/2023;
  • investment firms (empresas de servicios de inversión) in letters a) and b) of Article 128.1 of Ley 6/2023;
  • the same types of entity authorised in another Member State or a third country, acting in Spain through a branch.

The article mentions only branches. It says nothing about firms providing services in Spain without an establishment, and it neither admits nor expressly excludes them. A firm passported only on a freedom-to-provide-services basis should not assume it qualifies. Until rules or guidance clarify the point, the safe reading is that a Spanish branch is the route the law names.

Payment institutions and e-money institutions are not on the list. Neither are management companies of collective investment schemes. Under Article 346, a provider may offer only reception and transmission of orders, execution of orders, portfolio management and investment advice (letters a, b, d and g of Article 125.1), and only if it is authorised for them. It may not lend to the holder to trade inside the account. The MiFID conduct rules apply in full, including the suitability and appropriateness tests in Articles 203 and following of Ley 6/2023.

4. Structure: two sub-accounts and a counterpart account

Article 344 splits the account into an operating cash sub-account in euros and a securities sub-account. Every account must also be linked to a cuenta de contrapartida. Article 342.1.f defines it as a payment account in the holder’s name with an entity authorised to provide payment services.

All money moves through that counterpart account:

  • contributions come only in cash, from the counterpart account (Articles 344.8 and 350.1);
  • withdrawals are paid only to the counterpart account;
  • dividends, attendance bonuses and any interest the provider pays on the cash balance are credited there, not to the account itself (Article 344.7);
  • maintenance, custody, management and transfer fees are charged there; only direct dealing costs may be taken from the cash sub-account.

The cash sub-account can never go negative. Its balance may not exceed EUR 1,500, except when it receives sale or redemption proceeds. The holder then has three months to invest or withdraw the excess. After that the provider must send the excess to the counterpart account, and it counts as a partial withdrawal (Article 344.4).

5. Caps, eligible assets and sanctions

If a holding stops being eligible, the provider must tell the holder without delay, with the cause, the fix, the deadline and the consequences. The cure period is three months. Under portfolio management or advice, the provider bears that period itself. If the problem is not fixed, the provider sells the asset and pays the proceeds to the counterpart account as a partial withdrawal (Article 349). The new Article 309 bis treats as very serious infringements accepting contributions over the cap, holding ineligible assets, and failing to sell after the cure period where the failure is the provider’s fault.

6. Tax treatment: Article 95 ter

Gains and losses on trades inside the account are not taxed until money is withdrawn. A total withdrawal is taxed on the account’s liquidation value less the contributions not yet recovered. A partial withdrawal is split pro rata between recovered contributions and gain. Losses on partial withdrawals are carried forward against later gains. The oldest contributions are treated as withdrawn first.

Gains attributable to contributions held for more than five years are excluded from tax: 100% up to a lifetime total of EUR 10,000 per taxpayer, then 20% of the remainder. Dividends stay outside the regime and are taxed normally. If the holder dies, stops being a Spanish taxpayer or breaches a requirement, the deferred gains become taxable. A breach also counts as a total withdrawal on the date it happens, without the five-year exclusion.

Article 95 ter.10 requires providers to report to the tax authority on holders, assets, contributions, transactions and income, in terms to be set by regulation. A separate “Reinversión” variant for proceeds of certain home sales has its own EUR 800,000 cap and an EUR 8,000 cash ceiling.

7. Transfers between providers: Article 347

The holder may move the whole account to another provider, never part of it, once per calendar year. A transfer does not count as a withdrawal or a new contribution, and the contributions keep their original dates. The holder applies to the new provider, which forwards the request. The old provider then has one business day to verify the request and send the full account history: opening date, contributions, withdrawals, contributions not yet recovered, portfolio with acquisition values, and losses carried forward. Both providers must complete the transfer within ten business days, barring force majeure. Assets that cannot move as they are must be sold inside the old account. A ministerial order will set the data format, the treatment of pending orders and a cap on transfer fees.

8. When it can actually be sold

Final provision eleven of Real Decreto-ley 29/2026 puts three conditions on the start date:

  1. the account may not be marketed or contracted until the ministerial order on the reporting duties under Article 95 ter.10 enters into force;
  2. fund units may be included only once the fund is entered in the CNMV Register of Eligible Funds, which the CNMV must create within four months of the decree’s entry into force (additional provision two). Until then, accounts may be sold with listed shares only;
  3. transfers between providers wait for the separate ministerial order under Article 347.

A search of the BOE on 19 October 2026 found no ministerial order on the account’s reporting duties. Until one is published and in force, no provider may sell the product.

9. Worked case: an EU investment firm without a Spanish branch

Facts: an investment firm authorised in another Member State serves Spanish retail clients under freedom to provide services and wants to launch a Financia Europa account.

Applicable rule: Article 343.c covers firms authorised elsewhere in the EU that act in Spain through a branch. The text does not mention cross-border services without a branch.

What the compliance officer does: records that the law lists branches only, and gets a written view from Spanish counsel or the CNMV before planning around the freedom-to-provide-services passport. Sets the timing of a branch notification against the expected launch date. Checks that the branch passport will cover the four investment services in Article 346.

Outcome: the product plan does not depend on a reading the text does not support.

10. Worked case: an e-money institution as the counterpart account

Facts: a payment or e-money institution passported into Spain offers IBAN accounts. Customers ask whether they can fund their Financia Europa account from it.

Applicable rule: Article 342.1.f requires only a payment account in the holder’s name with an entity authorised to provide payment services. The preamble calls it a “bank” counterpart account, but the operative definition does not limit it to credit institutions.

What the compliance officer does: confirms the product is a payment account in the customer’s own name, as contributions must come from an account the taxpayer holds (Article 344.8). Briefs support that dividends, fees and forced withdrawals will arrive in or be charged to this account. Avoids marketing the account itself, because the institution is not a provider.

Outcome: the institution can serve as the cash side without overstepping its licence.

11. Worked case: a Spanish investment firm preparing the launch

Facts: a Spanish investment firm wants to be ready on the first permitted day.

Applicable rule: marketing waits for the reporting order, funds wait for the CNMV register, and transfers wait for the Article 347 order. The contract must state prominently the one-account rule, the contribution cap, the eligible-asset rules, the tax references and any capital guarantee. Before opening, the client must sign a declaration that they hold no other account (Article 345).

What the compliance officer does: drafts the contract and the declaration now, builds a hard block at EUR 150,000 and automates the three-month cash sweep and the Article 349 notices.

Outcome: a launch ready for the day the order takes effect, with the very serious infringements controlled in the system.

FAQ

Is the Financia Europa account in force?

The legal regime is in force under Real Decreto-ley 29/2026 from 8 October 2026, subject to validation. The account cannot be marketed or contracted until the ministerial order on reporting duties takes effect.

What happened to Real Decreto-ley 26/2026?

The Congress of Deputies repealed it on 2 October 2026 (BOE-A-2026-20526). The account provisions were re-enacted unchanged in Real Decreto-ley 29/2026.

Can an EU firm offer it without a Spanish branch?

Article 343 lists branches only. It does not expressly address cross-border services without a branch, so get specific advice before relying on that route.

What is the contribution limit?

EUR 150,000 of contributions not yet recovered, per taxpayer.

How often can the account be moved to another provider?

Once per calendar year, as a whole, within ten business days of the information handover. Transfers wait for a ministerial order.
